July 2014 Florida Bar Exam Results
The July 2014 Florida Bar Exam results were released on September 22, 2014, on the Florida Supreme Court’s website. Notice of the posting was sent via the Court’s Twitter feed (https://twitter.com/flcourts or @flcourts). We will keep you updated as more information develops. How Difficult was the July 2014 FL Bar Exam?
As we understand it, the July 2014 Florida Bar Exam was quite difficult. Indeed, “brutal” according to some applicants. For the essay section the examiners double-tested Contracts and Ethics. There was a cross-over question of one of the new Florida subjects—UCC 3 Negotiable Instruments—including a Trusts question. For the multiple-choice section it seems that the examiners deviated from their standard pattern of tested subjects.
The standard pattern would have been Business Entities, Wills & Admin of Estates, and Florida Procedure. Instead, the actual subjects were Business Entities, Evidence, and Florida Procedure. We were somewhat taken aback by the double essay Contracts questions and the multiple-choice Evidence questions. We anticipated the UCC, Trusts, and Ethics essay questions, as well as the Business Entities and Florida Procedure multiple-choice questions. However, given that the examiners can basically do what they please when it comes to the tested subjects, we should know by now not to be dismayed by any of the actual tested subjects or questions. Hence, one of the many reasons why we typically include a caveat when making exam predictions.

Just an FYI - Florida evidence is always tested in multiple choice. Florida Procedure is on every exam in multiple choice and Florida Evidence is on almost every exam and only in multiple choice. Then the third section is either Business entities or Estates and Trusts.

BarBri Florida Testing Books I and II have proven helpful for some applicants. Both books contain simulated Florida multiple-choice questions. You can possibly find used BarBri Florida Testing Books online at Amazon, eBay, or Craig’s List. Otherwise you should be able to purchase them directly from BarBri. Took and passed the July 2014 bar exam. I am an out of state taker, took Michigan back 5 years ago. While the essays were a little unexpected, the subjects were broad enough to hit many fine legal points. The MBE felt infinitely more difficult than I remembered. This could be faulty memory on my part or the years out of “testing mode”. Either way I am thrilled it is over and thank you and your blog/website for all the helpful information.

If the exam was harder for everyone, does that correlate to a higher or lower passage rate? Also. The February exam pass rates were about 7 points lower, is a 72% pass rate the new trend?

Tough questions! We are not sure we can answer them but we shall try. … In our view, if the exam was harder for everyone, it seems that the passage rate would even itself out. The passage rate would neither be higher nor lower. For example, the essays are scaled by the Florida Board of Bar Examiners. This means that all of the examinees’ essay scores are taken into consideration with the Board’s essay scaling methodology. Hence, if the essays were hard for everyone, then the overall scaling should reflect the essays’ degree of difficulty and should be scaled accordingly for all examinees’ (see, e.g., Raw Scores February 2014 (specifically, Part A numbers 1-3, the essays’ range raw score v. perfect raw score); see also Grading-Raw Score to Scaled Score, and
Raw Scores February 2013 (explains mean, range, and perfect raw scores).
As for a 72% pass rate being the new trend, we can’t really answer that with any degree of confidence. Based on statistical datum from the July 2013 Florida Bar Exam results, the overall pass/fail rate for all examinees’ was indeed 72% (71.8%). However, the pass/fail rate for first time test takers’ was 77.2 percent. The Board only calculates the pass/fail percentage rate for first time test takers which thereby excludes the pass/fail percentage rate for exam repeaters. So, it seems that the pass/fail percentage rate varies depending on how one calculates the numbers. If we take all of the examinees’ scores from July 2013 and use those numbers alone, then it is fair to say that 72% was the pass rate for the July 2013 Florida Bar Exam. Other than that, we cannot reasonably conclude that a 72% pass rate is the new trend.

Those might have been “tough” questions but they’re somewhat silly questions that don’t give any facts to support the questions. Where’d Paul L get his information? We’ve read your blog posts and don’t see anything that says February had a 7 point drop. Where’d that information come from? Is it even true? Was there a 7 point drop in February? BTW, what February exam is he talking about? Can’t be the Feb 2014 exam. The July 2014 results haven’t even come out yet. Is he talking about 2013?
