February 2015 Pass Rate−Not Good!

The overall pass rate for first-time test takers was a plummeting 64.3 percent! Wow! That is the lowest pass/fail rate for the Florida Bar Exam in six years. Prior to the February 2015 exam, the lowest pass/fail rate was 70.7 percent (see Feb 2009 Overall Scores). So, if you failed the February 2015 Florida Bar Exam, just know that you were in the company of at least 35.7 percent other Florida Bar Exam test takers.

Is the Florida Bar Exam Becoming More Difficult?

Based on the overall stats, one cannot necessarily conclude that the exam has become more difficult. Indeed, in our view, based on the Florida Board of Bar Examiners last two exams (viz., Feb 2015 and July 2014), one could feasibly conclude otherwise, which we will address below.

In February 2015, the examiners surprisingly tested on Federal Constitutional Law, as opposed to Florida Constitutional Law. Federal Constitutional Law has not been directly tested in essay format since July 2004, and even then, it was tested in conjunction with Florida Constitutional Law. In July 2014, the examiners double-tested Contracts; but not surprisingly, they tested one of the Contracts questions in conjunction with a UCC 3 question. Nevertheless, that was the first time that the examiners double-tested Contracts since at least July 2003 (see, e.g., 12-Year FL Bar Exam Essay Graph).

Rather than concluding that the Florida Bar Exam is becoming more difficult, it is easier to conclude that the Florida Board of Bar Examiners are doing their utmost to become less predictable. Who knows?

How Does this Impact the July 2015 FL Bar Exam?

We do not want to add more pressure to the July 2015 Florida Bar Exam test-takers, however, we get the distinct impression that the examiners are going to throw a curve ball with the July 2015 exam. If you are a self-studier, do your utmost to be well prepared for all of the Florida testable subjects, including Dependency Law and Juvenile Delinquency Law. Neither one of those two new subjects have yet to be tested. We might add being well prepared for Criminal Law also. … Just our own personal thoughts and our own personal views.
